I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?
What is the starting date on your H1-B petition?
You cannot get a VISA stamp earlier than within 20 days of the start date (I actually do not recall if it is 20 days or 15 days -- but it is around that many days).

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?

You may apply for AP at any time right? If you apply now, it is very unlikely that you will receive before your June end travel. And if you don't get your GC in june what will you do ? see, it is very easy to ask confusing questions. :)

It is always recommended to renew both EAD and AP together, though you can chose to renew only AP.
My guess is that 120 day rule applies to EAD only, and not AP.
You can renew EAD after it has expired, but again it is recommended to at least send in the application BEFORE the expiry date.

Pls. google USCIS pages for official info. You cannot stay for more than 6 months away from US each year every year. The situation might be different if its a US based company abroad.

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?
I have not found any specific details in regard.

Pending EB2 cases for china are around 2000 as per USCIS inventory .
but as per DOS Demand data its only 500 ..

I haven't had "any" FP yet, but I have my EAD and my advanced parole for tavel. I also have my H1B current and stamped in my passport.
Last time I got H1B stamped in the embassy, they took my fingerprits, 10 fingers (I also asked if they want the 10 toes :D)
Can that fingerprinting in the embassy be the reason why they haven't sent any notices for my fingerprinting?
Should I be worried?
Can somebody, please, tell me how do you ask for a service request?

It is possible. There is a relatively unknown technique called TT (abbreviation for Time Travel) which is also relatively related to relativity. When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green. Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

One of the questions on I-140 RFE goes like this:
"Submit evidence that the alien obtained the required two(2) years of programmer analyst experience in the job offered before the priority date was established on June 26, 2006. Evidence ...."
In reality the labor was filled for this EB3 I-140 in August 2003. This is not a substitution. I dont understand what they mean by "establised on June 26, 2006"? Can someone interpret this?

My wife is maintaining her H4 status since Feb 07 and last entered US on H4 visa in July 2010, we have our EAD cards based on pending I485 filed in Aug 07. Her AP is valid till Jan 2011 and I am on H1B. she started working on EAD couple of weeks ago.
My question is: does the fact that she entered last on H4 affects her ability to work on EAD? Will it cause any problems in I485 approval.
Since she is working on EAD, her status is no longer H4 (the new status is AOS, so to speak). Other than that, there is no issue.

Yes you can apply for EAD and AP separetly anytime
The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.
I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now

I'm in my 3rd year of my first H1-B which will be expired Sep. 2011.
If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?
