Inorder to apply for your 7th year extension, you should have an approved labor certification.
I am not sure if you can get an extension without an approved labor and I140.
You might have a problem.
Also, if you have an approved I40, you should have applied for an extension months before.
You really need a lawyer.

Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws. Hi,
Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

Family 4th preference is retrogressed by a decade ( or two if you are from Philippines), so you may have to wait another 10 years to be eligible to file i-485.:confused:

Did you get an answer from your attorney?
Attorney confirmed that correction was made before final filing.
Also said that the Labor Certification was tied to my I-140 which also got approved.

While filling the I-94 arrival record, My Friend did not give his last name at all . There was only two fields he filled 1. Given/First Name & 2. Date of Birth only.
So the I-94 record does not have his Family (Last) Name.
Is there any other center available so that he can give his last name for I-94 or he has to file the form I-102 (the disadvantage for filing the form is he has to send the original I-94 along with $320)

I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.

I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?

I went back to Russia, and finished the last year of high school there.
Then in '99 I came back to the USA on an F1 visa, did a four year college. After that I have been continuously employed on H1b, filed for green card in 2007.
RFE is requesting information about Section 212 of Immigration and Nationality Act.
How big of a trouble am I in?

With the opening of its first New Delhi outlet, ice cream brand Haagen Dazs adopted an interesting if not ridiculous policy: those with international passports were allowed in while Indians themselves weren't. Times of India's Rajesh Kalra provides a tale of a friend who was turned away by Haagen-Dazs enforcers. Here's a brief excerpt:
"I immediately called Ramit. 'You are an international traveler, and you have a passport, so you can go in', I said. Ramit's response was instant: I tried to enter but they said you are not allowed for you don't have an international passport. I am normally not given to immediate emotional reactions, but I couldn't resist this time. I was, to be honest, upset. How can they do this to an Indian, in India? Do a story on TOI or NBT? Do it for print or Online? Call other media friends and colleagues? I simply didn't know how to react. Print would have a better impact, but should I wait that long?"
Kalra didn't wait long. He contacted local authorities and used Facebook and Twitter to get the word out to the Indian community and as expected, HD's actions drew plenty of ire. According to BoingBoing, after a fitting public outcry thanks in part to Kalra's efforts, the operator of the franchise (who ironically is Indian) has axed the policy and apparently now claims it never existed.
Kalra, though, chalks this discrimination up to an age-old mentality of some Indian people. "I have often maintained that we ourselves are our biggest enemies. Our mentality is that of slaves and we think anything is good only if its approved by foreigners, or the 'holders of international passport[s].'"
