Gurus,
My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....
No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.

Hi :
I had applied for H1 when from india apil 2007, and in may 2007 i entered US on H4. My h1 got approved in aug 2007 asking me to get the stamping done from india. My consultant applied for H1 amendment on sep 21 2007. Its 8 weeks now, still not got any reply from INS.
1. I would like to know, how long does it generally take for h1 B amendment process.
2. Since the amendment is taking a long, can i go to mexico and re-enter
Regards,
Tanya

after you recieve the EAD card you have to apply for SSN at your local SSN office.the time period to recieve SSN is different in different states.i guess the minimum time is 15 business days. please correct me if I am wrong.

From my knowledge...
For now you can use EAD and continue to work.
In Long term you can get your GC refiled from a different company and port priority date

The petals are great, but the ones in the background are distracting to me, as I think you were alluding to. I like the shape and the color a lot.

nope. not at all. if you want a camera that takes short video clips almost all of the consumer level point and shoot cameras take a video clip with sound and all of them no mater the quality of camera shoot at 640x480 resolution at 30 frames per second. all told they are kinda fun to use and most will shoot for however long your media card allows before running out of space on a 2 gig card you can figure about 30 minutes worth. and also for the video feature some of the low end 100 dollar cameras take just as good quality video as the upper level ones. in fact in my case my wife owns a samsung dig cam that is under 100 bucks and it outperforms my canon digital elph in video for the reason that the lens on hers can zoom in and out opticly while recording my 250 dollar digital elph can zoom opticly before the record button is pushed but once you start recording it will zoom but only digitally which makes for low quality at 640x480 resolution. so i say buy the d40x or the canon rebel xti and then buy a point and shoot camera for the video clips. hope this steers you in the right direction.

Immigration Visa Attorney Blog Has Just Posted the Following:
http://www.immigrationvisaattorneyblog.com/Magnify%20Glass.jpgIn our blog of yesterday (http://www.immigrationvisaattorneyblog.com/2010/04/border-guards-will-finally-use.html), 1 April 2010, we mentioned the new screening procedures at US ports of entry (POE). Fong & Chun's clients travel a great deal, passing through Los Angeles and other immigration ports of entry. As lawyers to so many travelers, we try to provide accurate information about border issues. We have learned a little more about the new screening protocol.
In the past, all citizens of certain countries believed to be supporters of terrorism would all be scrutinized indiscriminately. Cuba, Iran, Iraq, Pakistan, Saudi Arabia, Somalia, and Sudan are widely believed to have been on this list of soi-disant unfriendly countries. Citizens of other countries -- perceived as "friendly" to the USA -- would be subject to less scrutiny.
The new POE screening procedures use intelligence-based threat assessments. This information will be applied to all persons arriving at a POE, including Americans. If border guards have intelligence that -- let's pretend for a moment -- a university-age male student from Africa might be trying to engage in dangerous activity, then the border guards would be on the lookout for university-age male students from Africa. In contrast, university-age male students from, say, Malaysia, Mxico, Moldova, Monaco, or Myanmar would not be subject to the same scrutiny.
This new, intelligence-based approach makes the most of the information provided by US intelligence sources without painting everyone with an indiscriminately broad brush. --jcf

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.

Hi, guys,
I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?
thanks.

from this report it seems like all the visa numbers are being used already atleast for years 2007-2009
i am assuming there were some visas lost before 2007. does anyone has any links justifying that.

Besides, depending upon how the "CLASS" is defined- you will not lose your claim if they win the lawsuit.
It does not require you to have filed your case to benefit from the class action , but it depends on how the class has been defined. You can goto Rajiv's website and hear the latest conference call recording which explains his opinion on this.

Hi,
I have received the EAD card yesterday with No finger prints available. But we have done our Finger printing before the EAD is approved. Approx 4 weeks before.
Is this normal? Or i should contact USCIS about this?
I know some applicants getting their EAD cards before finger prints were taken for them No finger prints available makes sense.
Any responses are appreciated
Regards.

Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways
Thanks for you responses.
