H-1B through non-profits like Universities does not have a cap. Your only bet would be to find a job through one such an entity and apply for H-1B. Then you can pursue H-1B through any commercial entity during 2008 quota starting from April 2007.

You can have a contract written for the required 5 yr period, where you and the employer have a without cause 60 or 90 day opt out clause. Many contracts are structured that way and there have not been problems previously. The main thing is the letter that comes form the State Dep't of heath supporting your petition. Speak with the point person in your state and they will be able to guide you.

I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.
Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

--> Submitted documents in 2009 and got stamping done in May 2009.
--> Now Employer B has applied for fresh H1B 2010.
My questions are,
When my petition is approved and having the petition in my hand, do i need to get the visa stamping before travelling for Employer B?:mad:
Will my visa stamp for Employer B only have the starting date to be from October 2011?:mad:
Is there any remote possibility that i can travel for my Employer B at any time earlier to October 2011?:mad:

Another question I had was about LUDs. I did my FP on Oct-29-07 on which date I also noticed an updated LUD (from Sep-25 to OCT-29).
However, on Oct-31, I noticed that the LUD was updated yet again to OCT-30.
Any idea what this could mean?

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

8/27 should be your Notice Date... per online status it will say received on 8/27.. but its ND... Once you get physical receipts... the RD has to be 7/24 in all normal scenarios... But for July fiasco filers.. I think it could be just 7/17... Update once you get the physical receipts.. I may be wrong... just noticed this in one case only yet...

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?

My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.
Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.
And there is nothing one can do about it, so i am thinking it will be alright.
We will be fine.

I am in the same situation. I have already sent my FOIA request about 3 weeks back. They have processed only 250 request in last one week. They have around 8600 requests. So it will take around 7 to 9 months to get the docs.
Since you will be asking only for I-140 and/or perm docs, there will be no cost.
You need to know SOC code/Job responsibilities/Salary for using AC-21.
Hopefully, some one who has more knowledge will reply to your other questions.

Hello ,
I entered USA in Dec. 2007 on H4 Visa valid till April 2010. I got my H1B approved in October 2008. I worked for few months, and due to bad economy I do not have any project since last 5 months and also no paystubs. I would like to change back to H4 status. But I understand that filing for change of status from within US might require latest paystubs. So I am planning to go to my Home country this month ( Nov 2009 ) and return in Jan 2010.
My questions are:
1) The H4 visa stamp on my passport is valid till Apr 2010. So can I simply enter USA with the same stamp and valid H1b petition from my spouse to get the new valid I-94 in H4 status?
2) Will there be any issue at Port of Entry ? Has anyone done this before ?
3) If this can be done then once I get valid I-94 with H4 status, Do I need to file any other form in addition like I-539 to be in proper status ?

My PD is Sep 2004 EB3. If I decide to move to another employer who could also file an EB2 labor for me, how long should I wait before they could file a EB2 perm application for me?
